A domestic violence injunction is a civil matter governed by Florida Statute Chapter 741. It enables a victim of domestic violence to get an injunction that will keep the perpetrator of the violence away from that victim. A violation may result in criminal contempt proceedings and criminal charges being filed by the State Attorney. After the Petition for the Injunction is filed, the judge will determine if there is cause for a temporary injunction. The judge has the following options: deny the petition, deny the temporary request and set the matter for hearing, or issue a temporary injunction and set the matter for hearing.

If a temporary injunction is issued, the hearing should be set within the next 14 days to allow the respondent an opportunity to respond to the allegations in the petition. This is not much time to prepare for a hearing, so an attorney should be consulted immediately. There are serious issues that are addressed in a DVI hearing, such as exclusive use and possession of the home, timesharing/custody, and support. Inadequate representation can result in prejudices to a later divorce matter.
